Terms of Use — TMT App

Welcome to TMT App, a classified ads platform in the State of Kuwait. By using the app, you agree to comply with the following terms and conditions. Please read them carefully before registering or posting any listing. If you do not agree with any part, please do not use the app.
1. Acceptance of Terms
By using TMT App or creating an account, you acknowledge that you have read, understood, and agree to be fully bound by these terms. These terms form a legally binding agreement between you and TBI Company.
2. Eligibility and Registration
You must be at least 17 years old to use the app, and be legally eligible to enter into contracts in the State of Kuwait or your country of residence. You must provide accurate, complete, and up-to-date information at registration. Only one account is allowed per person; multiple accounts may be suspended.
For minors: The app is not intended for those under 17 years of age. If we discover that a minor has registered, we will close the account immediately and delete their data.
3. Personal Account
You are responsible for maintaining the confidentiality of your account information (password and verification code) and for all activities under your account. You must notify us immediately of any unauthorized use, and update your personal information when it changes. We are not liable for any losses arising from your negligence in protecting your account or sharing its information with others.
4. Posting Listings
When posting a listing on the app, you represent and warrant that:
- The content is accurate, correct, and not misleading.
- The advertised product or service is legal and actually available.
- Attached images are owned by you or you have permission to use them.
- The advertised price is clear and contains no hidden fees.
- The listing does not violate Kuwaiti laws or others' intellectual property rights.
We reserve the right to reject or remove any listing that does not comply with these terms, or to suspend the owner's account, without prior notice.
5. Prohibited Content
- Legally prohibited substances (drugs and intoxicants).
- Firearms, ammunition, and explosives.
- Counterfeit or stolen products.
- Pornographic or offensive content.
- Racist, sectarian, or hate-inciting content.
- Unlicensed financial services.
- Fraudulent activities and pyramid marketing.
- Smuggled animals.
- Any content violating public decency or applicable laws and regulations in the State of Kuwait.
6. Zero Tolerance for Objectionable Content
TMT App is committed to a zero-tolerance policy for any objectionable content or harassment between users. We commit to:
- Reviewing listings before publishing.
- Removing any violating content within 24 hours of receiving a report.
- Suspending accounts that repeatedly post objectionable content.
- Reporting to authorities in cases of fraud or serious threats.
7. Reporting and Blocking
If you encounter a violating listing or user, you can use the "Report" button in the app and we will review the report within 24 hours. You can also block any user at any time from their profile page or your conversations with them; when blocked, the user cannot send you messages, their listings will not appear in your search results, and your listings will not appear to them.
Upon confirmation of a violation, we take one or more of the following actions:
- Remove the violating content.
- Warn the user.
- Temporarily suspend the account.
- Permanent ban.
- Report to authorities in serious cases.
8. User-to-User Transactions
TMT App acts as an intermediary platform connecting buyers and sellers only, and is not a party to any transaction. We bear no responsibility for:
- The quality of products or services offered.
- Any disputes between users.
- Fraud incidents.
- Physical and financial damages resulting from transactions.
Safety Tips: Inspect products thoroughly before purchase, transact in public and safe places, avoid prepayment to untrusted persons, and never share your banking information or OTP code with anyone.
9. Fees and Payments
Some services in the app are free and some require fees, such as featured ads, advertising banners, and paid plans. You will be notified of any fees before completing the payment.
Payment Methods:
- On iOS: Payments are made exclusively via Apple In-App Purchase for digital services.
- On Android: Via Tap Payments (KNet, Visa, MasterCard).
All payments are non-refundable except in cases of confirmed technical errors or in accordance with Apple's policy.
10. "Support the App" Screen
After successfully selling your listing, you may see an optional screen to donate a small amount to support the app's development. This feature is entirely optional and can be skipped without any impact on your use of the app.
- On iOS: Processed via Apple In-App Purchase (Consumable).
- On Android: The donation feature is currently unavailable.
The donated amount is non-refundable except in cases of technical errors, and not donating imposes no restrictions on app use.
11. Intellectual Property Rights
All intellectual property rights of the app — including design, logo, code, icons, interfaces, and content produced by us — belong to TBI Company. It is prohibited to copy, modify, distribute any part of the app, reverse engineer, or use the logo and trademark without prior written permission.
User Content: The content you post (listings, photos, text) remains your property, but you grant us a non-exclusive, worldwide, royalty-free license to use and display it within the app and in related marketing materials.
12. Disclaimer of Liability
The app is provided "as is" without any warranties. We do not guarantee:
- The app will work without interruption or errors.
- The accuracy of information provided by users.
- The service will not be disrupted due to maintenance or emergencies.
To the maximum extent permitted by law, our liability is limited to amounts you paid to the app during the last 12 months.
13. Account Termination
You may delete your account at any time through app settings, and your data will be deleted within 30 days of the request date. We also have the right to suspend or terminate your account in cases of:
- Violating these terms.
- Repeatedly posting violating content.
- Using the app for fraudulent purposes.
- Abusing other users.
- Inactivity for a long period (two years or more).
14. Apple App Store Terms
If you use the app on iOS, the following terms apply additionally:
- This agreement is between you and TABI Company — not between you and Apple Inc.
- Apple is considered a Third-Party Beneficiary of this agreement and has the right to enforce it against you.
- Apple is not responsible for the app, its content, its support, or any claims related to it.
- Compliance with Apple's App Store Terms of Service.
- Do not use the app if you are in a country embargoed by the U.S. government or on a list of prohibited persons.
15. Modification of Terms
We reserve the right to modify these terms at any time. You will be notified of any material changes via in-app notification or registered email, at least 14 days before the change takes effect. Your continued use of the app after the modification constitutes acceptance of the updated terms, and if you do not agree, you may delete your account.
16. Governing Law
These terms are governed by and interpreted in accordance with the laws of the State of Kuwait. Any disputes arising from app use are subject to the exclusive jurisdiction of Kuwaiti courts.
